U.S. Supreme Court upholds health care mandate

Thursday, June 28, 2012

In a decision today, the U.S. Supreme Court has upheld the controversial healthcare law, the Patient Protection and Affordable Care Act, passed in 2010. The Supreme Court also upheld the individual mandate provision of the law, which would require most U.S. citizens to obtain health insurance by 2014, or pay a monetary penalty.

The Supreme Court ruled on the law 5–4. Chief Justice John Roberts authored the majority opinion. Justices Stephen Breyer, Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor jointed Roberts in the majority, while Samuel Alito, Anthony Kennedy, Antonin Scalia and Clarence Thomas were in the minority in supporting the repeal of the law.

The Court did, however, strike down a provision of the law which would have expanded Medicaid to make coverage available to anyone with an income less than 138% of the federal poverty line.

President Barack Obama made a public statement from the White House saying that the Supreme Court’s upholding of the law, “reaffirmed a fundamental principle that here in America — in the wealthiest nation on Earth – no illness or accident should lead to any family’s financial ruin.” Obama further added, “Whatever the politics, today’s decision was a victory for people all over this country whose lives will be more secure because of this law and the Supreme Court’s decision to uphold it.” Obama closed his statement by saying, “The highest Court in the land has now spoken. We will continue to implement this law. And we’ll work together to improve on it where we can. But what we won’t do — what the country can’t afford to do — is refight the political battles of two years ago, or go back to the way things were.” Adding, “With today’s announcement, it’s time for us to move forward — to implement and, where necessary, improve on this law.”

Republican presidential candidate Mitt Romney also gave a statement from Washington, D.C. saying, “What the Court did not do on its last day in session, I will do on my first day if elected President of the United States. And that is I will act to repeal Obamacare.” Romney clarified further by saying, “Let’s make clear that we understand what the Court did and did not do. What the Court did today was say that Obamacare does not violate the Constitution. What they did not do was say that Obamacare is good law or that it’s good policy.” Further adding, “Obamacare was bad policy yesterday. It’s bad policy today. Obamacare was bad law yesterday. It’s bad law today.” Romney closed by saying, “Our mission is clear: If we want to get rid of Obamacare, we’re going to have to replace President Obama.”

Eric Cantor, Republican leader in the U.S. House of Representatives, announced shortly after the ruling that the House would vote on repealing the law on July 11, following the July 4 holiday recess. Cantor said, “The Supreme Court’s decision to uphold Obamacare is a crushing blow to patients throughout the country. Obamacare has failed to keep the President’s basic promise of allowing those who like their health care to keep it, while increasing costs and reducing access to quality care for patients.”

In the ruling of National Federation of Independent Business v. Sebelius, John Roberts wrote, “Simply put, Congress may tax and spend. The federal government may enact a tax on an activity that it cannot authorize, forbid or otherwise control.” Meanwhile, Justice Anthony Kennedy authored the dissenting opinion, saying the entire law should have been repealed.

The ruling on the law comes after 26 states challenged the law in oral arguments in front of the Supreme Court in March.

Race to save Chilean miners trapped underground from spiralling into depression continues

Thursday, September 2, 2010

It has emerged that the 33 Chilean miners trapped underground after the mine they were working in collapsed could be brought to the surface in a shorter time than was initially feared. While officials publicly announced that the men would not be brought to the surface until Christmas, sources inside technical meetings have revealed that they could in fact be on the surface by early November. The news comes as families were allowed to speak by radio-telephone to their trapped loved ones on Sunday. Over the weekend, video images filmed by the miners emerged showing the miners playing dominoes at a table and singing the Chilean national anthem. The miners also used the camera to send video messages to their families on the surface, saying that they regularly broke into tears, but were feeling better having received food and water.

The grainy nightvision images, filmed on a high definition camcorder that was sent down a small shaft to the mine, show the men in good spirits, chanting “long live Chile, and long live the miners.” They are unshaven and stripped to the waist because of the heat underground, and are seen wearing white clinical trousers that have been designed to keep them dry. Giving a guided tour of the area they are occupying, Mario Sepúlveda, one of the miners, explains they have a “little cup to brush our teeth”, and a place where they pray each day. “We have everything organized,” he tells the camera. Gesturing to the table in the center of the room, he says that “we meet here every day. We plan, we have assemblies here every day so that all the decisions we make are based on the thoughts of all 33.” Another unidentified miner asks to rescuers, “get us out of here soon, please.” A thermometer is shown in the video, reading 29.5C (85F).

As the film continues, it becomes evident that the miners have stuck a poster of a topless woman on the wall. The miners appear shy, and one man puts his hand to his face, presumably dazzled by the light mounted on the cameraman’s helmet. One miner sent a message to his family. “Be calm”, he says. “We’re going to get out of here. And we thank you from the bottom of our hearts for your efforts.” Another said that the miners are “sure that there are people here in Chile that are big people, that are powerful people, that are intelligent people, and they have the technology and they will all work together to get us out of here.” Speaking to the camera, one says: “we have had the great fortune that trapped in this mine there are good, professional people. We have electricians, we have mechanics, we have machine operators and we will let you know that while you are working to rescue us on the surface, we are down here ready to help you too.” It has been reported that Mario Gómez, 63, has become the group’s “spiritual leader”, having worked in the mines for over fifty years. He has requested that materials to build a shrine be sent down to the cavern.

Upon seeing the video in a private screening, family members, who are living in a small village of tents at the entrance to the San José copper-gold mine—which they have named Camp Hope—were elated. “He’s skinny, bearded and it was painful to see him with his head hanging down, but I am so happy to see him alive”, said Ruth Contreras, the mother of Carlos Bravo, who is trapped in the mine. The video, of which only a small portion has been released to the public, shows the miners, many of them wearing helmets, cracking jokes and thanking the rescuers for their continued efforts. The supplies are being sent to the men through a small shaft only twelve centimeters wide, and a laboratory has been set up with the purpose of designing collapsible cots and miniature sandwiches, which can be sent down such a narrow space.

CNN reported on Friday that “officials are splitting the men into two shifts so one group sleeps while the other works or has leisure time .. On average, each man has lost 22 pounds (10 kilograms) since they became trapped three weeks ago, and dehydration remains a threat. But a survey of the men indicates that at least nine miners are still too overweight to fit through the proposed rescue shaft. Initially, the miners survived by draining water from a water-cooled piece of equipment. To stay hydrated in the 90-degree mine, each miner must drink eight or nine pints of water per day.”

But while there are jubilant celebrations on the surface that the miners are alive, officials are now nervous that the miners could become depressed, trapped in a dark room the size of a small apartment. Chilean health minister Jaime Mañalich said that, on the video, he saw the telltale signs of depression. “They are more isolated, they don’t want to be on the screen, they are not eating well”, he said. “I would say depression is the correct word.” He said that doctors who had watched the video had observed the men suffering from “severe dermatological problems.” Dr. Rodrigo Figueroa, head of the trauma, stress and disaster unit at the Catholic University in Santiago, Chile, explained that “following the euphoria of being discovered, the normal psychological reaction would be for the men to collapse in a combination of fatigue and stress … People who are trained for emergencies – like these miners – tend to minimize their own needs or to ignore them. When it is time to ask for help, they don’t.” NASA has advised emergency workers that entertaining the miners would be a good idea. They are to be sent a television system complete with taped football matches. Another dilemma facing Mañalich is whether the miners should be permitted to smoke underground. While nicotine gum has been delivered to the miners, sending down cigarettes is a plan that has not been ruled out.

With the news that drilling of the main rescue tunnel was expected to begin on Monday, officials have informed the media that they hope to have the miners out of the mine by Christmas—but sources with access to technical meetings have suggested that the miners could actually be rescued by the first week of November. A news report described the rescue plan—”the main focus is a machine that bores straight down to 688m and creates a chimney-type duct that could be used to haul the miners out one by one in a rescue basket. A second drilling operation will attempt to intercept a mining tunnel at a depth of roughly 350m. The miners would then have to make their way through several miles of dark, muddy tunnels and meet the rescue drill at roughly the halfway point of their current depth of 688m.” Iván Viveros Aranas, a Chilean policeman working at Camp Hope, told reporters that Chile “has shown a unity regardless of religion or social class. You see people arriving here just to volunteer, they have no relation at all to these families.”

But over the weekend, The New York Times reported that the “miners who have astonished the world with their discipline a half-mile underground will have to aid their own escape — clearing 3,000 to 4,000 tons of rock that will fall as the rescue hole is drilled, the engineer in charge of drilling said Sunday … The work will require about a half-dozen men working in shifts 24 hours a day.” Andrés Sougarret, a senior engineer involved in operating the drill said that “the miners are going to have to take out all that material as it falls.”

The families of those trapped were allowed to speak to them by radio-telephone on Sunday—a possibility that brought reassurance both the miners and those on the surface. The Intendant of the Atacama Region, Ximena Matas, said that there had been “moments of great emotion.” She continued to say that the families “listened with great interest and they both felt and realized that the men are well. This has been a very important moment, which no doubt strengthens their [the miners’] morale.” The phone line is thought to be quite temperamental, but it is hoped that soon, those in the mine and those in Camp Hope will be able to talk every day. “To hear his voice was a balm to my heart … He is aware that the rescue is not going to happen today, that it will take some time. He asked us to stay calm as everything is going to be OK … He sounded relaxed and since it was so short I didn’t manage to ask anything. Twenty seconds was nothing”, said said Jessica Cortés, who spoke to her husband Víctor Zamora, who was not even a miner, but a vehicle mechanic. “He went in that day because a vehicle had broken down inside the mine … At first they told us he had been crushed [to death].”

Esteban Rojas sent up a letter from inside the mine, proposing to his long-time partner Jessica Yáñez, 43. While they have officially been married for 25 years, their wedding was a civil service—but Rojas has now promised to have a church ceremony which is customary in Chile. “Please keep praying that we get out of this alive. And when I do get out, we will buy a dress and get married,” the letter read. Yáñez told a newspaper that she thought he was never going to ask her. “We have talked about it before, but he never asked me … He knows that however long it takes, I’ll wait for him, because with him I’ve been through good and bad.”

US Senate passes new bankruptcy bill

Saturday, March 12, 2005

In a vote of 74-25 last Thursday, the US Senate passed a measure that would change bankruptcy laws, making it harder for individuals seeking relief from their debt burden to avoid repayment. Almost twenty Democrats joined Republicans, who currently hold a majority of the seats in the US Senate, in passing the bill.

Lobbyists for credit card companies and financial services firms have worked for the bill during the last two administrations. A similar measure passed both the Senate and House during the previous administration, but then President Bill Clinton pocket-vetoed the measure in 2000.

Democrats sought to soften the bill by allowing bankruptcy filers to negotiate directly with lenders for relief, but the amendments were defeated by the Republican-controlled Senate. Proponents of the bill claim the rise of bankruptcy filings to nearly 1.5 million a year shows that abusers of credit use the filings to shield themselves from irresponsible practices.

“There has been an explosion of bankruptcy,” said Iowa Republican Sen. Charles E. Grassley, the bill’s sponsor. “We preserve the principle of a fresh start, but we also establish a principle that if you have the ability to repay some of your debt, you are not going to get off scot-free.” However, Massachusetts Democratic Sen., Edward M. Kennedy said, “This legislation makes the bankruptcy courts of the United States the collection agency for the credit-card industry.”

The bill impacts a broad spectrum of bankruptcy law, but the most significant impact is on personal bankruptcy filings. Individuals who get behind in repaying credit card debt face high interest charges and stiff late payment fees. By only meeting minimum payment requirements, borrowers remit to the lender over the life of the loan an amount in interest and other fees that can far exceed the value of the principal balance of the loan. This can put consumers who run up high balances on various cards at financial risk of default. Critics of the bill blame these aggressive lending practices as a contributing factor in the rising trend of bankruptcy filings from 1996.

The proposed bill doesn’t only affect debtors with credit card debt.

It also affects debtors who have run up large medical bills.

Patients with a past medical history that disqualifies them from full medical coverage, can easily find themselves facing insurmountable medical bills after just a short stay in the hospital. These individuals will no longer be able to get a fresh start after these personal disasters, and will be forced to live in poverty until they can pay off their medical bills as part of their Chapter 13 filing. (Prior to this bill, they would have been able to file Chapter 7, completely discharging their debt.)

Chapter 7, which accounts for 70% of bankruptcy filings, allows individuals to eliminate most non-secured debts after liquidating assets, with the notable exemption of one’s principle residence in most states. The Senate passed bill would change Chapter 7 eligibility by applying a means-test, where those with a median income higher than the state average would be required to file under Chapter 13 provisions. Under Chapter 13 protection, an individual’s debt is not forgiven; rather it is restructured for payment under more lenient terms.

This was the first major overhaul of federal bankruptcy law in many years.

Under the old bankruptcy law, a personal bankruptcy attorney could not be held financially responsible for his clients mendacity. Under the new bankruptcy law, the bankruptcy attorney is responsible for his client’s lies to the Court about his assets and the bankruptcy attorney and his insurance carrier can be held responsible by the Bankruptcy Court.

The result is that personal bankruptcy attorneys (this does not apply to corporate bankruptcy attorneys) are likely to flee the personal bankruptcy field when the new law takes effect. Their insurance companies will not offer the sort of coverage that they would need to continue to practice.

So when consumers need to file personal bankruptcy under the new law, they will be unlikely to find a bankruptcy attorney to represent them. Consumers will have to file pro se: such consumers will be likely to fail due to the complexity of the law.

The bottom line is that the field of personal bankruptcy law as a practice area of law will cease to exist when the new bankruptcy law takes effect, and consumers will be unable to secure legal counsel and so consumers will lose what legal protections counsel now affords them.

Under the new bankruptcy law about one half million Americans will be forest to pay for at lest 5 years on longer they will be held in servitude as chattel they will be completely subservient to a dominating influence of the company that holds the loan. Their loan will be put on the market for sale for profit. The people will be forced to work harder. People who fail to go to court will have a arrest warrant made out in their name and people who refuseto pay. They will be subject to fines and or jail. About fifty thousand Americans will punished by a fine and or about three thousand Americans every year will go to jail under the new bankruptcy law. For some people this will be a third strike they will be put in jail for life.

The bill has the support of President Bush, and its passage in the House sometime next month seems likely. If enacted into law, lending companies will recover more money on what otherwise would be written off as bad loans. Those persons of median and higher income seeking relief would be required to file under Chapter 13 status and pay up to $100 per month under court imposed conditions. It is expected the proposed changes would cause a sharp increase in filings before the new law could take effect.

Itch Eresting Facts About Head Lice

Submitted by: Jeff Foster

Head lice; defined as common insect infestation of the human head hair. Most likely, you remember when you were young and had your own little encounter with this little pesky insect.

Head lice lay eggs in the human scalp and can only survive on human hair. Of course, despite contrary belief, it doesn t even matter if your hair is silky clean or greasy dirty everyone is susceptible to head lice.

The reason why it doesn t matter the status of your hair is because each little lice has long front legs which grip into your scalp. Neither shampoo, water, nor hardly anything else can shake it of its home.

The head lice has adapted over millions of year to suit the environment of the human head. Even back in the times of mummies in Ancient Egypt, they showed evidence of retaining head lice.

They can not survive anywhere else besides your head and so if they do happen to fall out, the lice surely die within 48 hours.

Head lice can lay over two hundred eggs in their lifetime, easy enough to begin an entire colony on your head.

This head lice is frequently found in children, ages 4 11, especially if they attend after school programs. Kids can easily contract head lice and share it with their peers, because really; kids what don t they share?

So the first thing that you might hear is a complaint of my head itches or you might notice your child consistently scratching their head.

Once your children have a lice infestation it is very common and rather easy for them to pass it on to you and other family and friends.

If they do happen to pass these little critters on to you don t worry. Head lice, although annoying, are not dangerous or carry disease. They only are an irritant and create irritation and give your scalp rashes.

Another inaccurate head lice myth is that they can fly. Can head lice fly? No, head lice do not have wings and therefore do not fly around from head to head. Lice may only change hosts through human contact; a hair brush, clothes where hair has been left, etc.

Dead or empty louse eggs are called nits. Even when most of the living lice have been destroyed from the scalp, the nits may still remain. Generally in school districts today, any child with nits are not allowed to attend schooling until they are nit-free.

Lice live for so long in the human hair by feeding off human blood. To do this they must penetrate the scalp and you d never even know it. In fact, nearly 5% of the United States population contracts head lice each year.

Do the math on that one; that s nearly 12 million people! Head lice may be small but they sure are getting attention all around the world.

Dozens killed after car bomb explodes in market in Peshawar, Pakistan

Wednesday, October 28, 2009

Pakistani officials have said that at least 100 people were killed and over 200 injured after a car bomb exploded in a marketplace in the city of Peshawar on Wednesday. The attack was the deadliest in the country in this year.

Initially, large fires were reported to be burning around the marketplace, which was crowded with people. The flames spread easily because there were many stores in the area selling flammable fabrics. Police said the blast was heard throughout most of the city, and the explosion reportedly left a hole in the ground up to ten feet wide.

The Associated Press reported that many of the victims are women.

“There was a huge blast. There was smoke and dust everywhere. I saw people dying and screaming on the road,” said an eyewitness, Mohammad Siddique, to the Agence France-Presse news agency.

Several buildings collapsed as a result of the detonation, and rescue workers searched through the rubble looking for survivors beneath the debris.

Muzamil Hussain, a member of local medical staff, described his experiences to the Associated Press: “There were a lot of wounded people. We tried to help them but there were no ambulances so we took the victims on rickshaws and other vehicles. There were no police. The police and government didn’t help us, the police even opened fire on us.”

“Bodies are scattered and badly burned because of the fire caused by the explosion. The explosion took place in a very crowded market,” Mohammed Naeem, a spokesman for a local ambulance service, said.

Some people expressed anger that the bombings managed to be carried out in broad daylight in a crowded area. “What kind of security alert is this? It was an explosives-packed car. Look at the mosque, it ceases to exist anymore. For God’s sake, do something,” said a local middle-aged shopkeeper, as quoted by the CNN news agency.

A state of emergency at the Lady Reading Hospital in Peshawar, where many of the wounded people were hospitalised, was called soon after the explosion. Hospital officials appealed to the public and to other medical centres for blood donations.

The bomb attack happened just hours after Hillary Clinton, the United States Secretary of State, flew to the nation to discuss peace with Pakistan’s military commanders and political figures. Clinton will be in Islamabad for three days.

Clinton condemned the attack. “These attacks on innocent people are cowardly. They are not courageous. If the people behind these attacks were so sure of their beliefs, let them join the political process,” she said.

The bombing also comes just days after Pakistani military forces captured the town of Kotkai, the hometown of Taliban Chief Hakimullah Mehsud, and one of his top officers, Qari Hussain.

Amazon.com to acquire Whole Foods at US$42 per share

Saturday, June 17, 2017

Yesterday, e-commerce giant Amazon.com announced they are to acquire Texas based retail grocery store chain Whole Foods Market at US$42 per share. According to the deal worth US$13.7 billion (£10.7 billion) the retail grocery store chain is to keep the Whole Foods Market brand name and John Mackey is reportedly to remain its CEO.

After the announcement, Amazon’s shares went up more than two percent and Whole Foods Market shares went up by about 28%. Shares of other grocery-selling chains like Kroger, Target, Sprouts Farmers and Costco experienced a dip after the announcement.

Amazon runs their own online grocery — Amazon Fresh — which started a decade ago in Seattle, Washington. Amazon’s? CEO Jeff Bezos said, “Millions of people love Whole Foods Market because they offer the best natural and organic foods, and they make it fun to eat healthy.”

Whole Foods Market started in 1978, and employs about 87000 people in its roughly 460 stores across the US, UK and Canada. The deal is expected to cover debts of Whole Foods Market.

Whole Foods Market CEO Mackey said, “This partnership presents an opportunity to maximize value for Whole Foods Market’s shareholders, while at the same time extending our mission and bringing the highest quality, experience, convenience and innovation to our customers.”

The acquisition, which has not yet received approval from the shareholders of Whole Foods Market, adds a 27% premium to Thursday’s closing value of its stock. This would be Amazon’s largest acquisition if the deal is done.
